1. Acceptance of Terms
Welcome to the official web portal of the National GST Association (NGSTA), accessible via www.ngsta.in (referred to as the "Website" or "Platform").
The National GST Association is an autonomous professional association registered under Registration No.: KUA/THANE/2305/2026, having its registered office at Sushila Sadan, Plot No. 464, B Cabin Road, Ambernath (East), Thane – 421501, Maharashtra, India.
By visiting, browsing, accessing, or registering as a member on this Website, you acknowledge that you have read, understood, and agreed to be legally bound by these Terms and Conditions, our Privacy Policy, and our Refund Policy. If you do not agree to any part of these terms, you must refrain from using the Website or applying for association membership.
2. Nature of the Association & Non-Governmental Status
- Autonomous Entity: The National GST Association (NGSTA) is an independent, non-governmental, and non-statutory professional collective created for knowledge-sharing, professional networking, and institutional advocacy.
- Not a Government Portal: NGSTA is not affiliated with, operated by, or an agency of the Central Board of Indirect Taxes and Customs (CBIC), the GST Council, or any Central/State Goods and Services Tax department.
- Informational Purpose: All articles, notification summaries, case study analyses, and statutory opinions published on the Website or shared via newsletters are provided solely for general informational and educational purposes. They do not constitute formal legal, accounting, auditing, or binding tax consultancy opinions.
3. Eligibility & Registration Accuracy
To register for NGSTA membership, you represent and warrant that:
- You are at least 18 years of age and legally competent to enter into a binding agreement under the Indian Contract Act, 1872.
- All information, documents, business names, identity credentials, and professional designations submitted during the registration process are true, accurate, current, and complete.
- You will not impersonate any person, business entity, or government agency, nor use a false or misleading identity or credential.
4. Automated Verification & Certificate Issuance
- Server-Side Payment Validation: In accordance with our security protocols, membership applications are approved and confirmed strictly through server-side payment verification. Client-side or browser-based success triggers are not accepted as proof of transaction.
- Instant Digital Certificate: Upon successful receipt and server validation of the prescribed registration fee, a unique sequence-based Member ID is generated, and a personalized digital Certificate of Membership is made available immediately for download.
- Legitimate Use of Certificate: The issued Certificate of Membership certifies your active membership status within the National GST Association. Members are strictly prohibited from altering, forging, tampering with, or falsely misrepresenting the certificate as a government-issued license or statutory tax assessment authority.
5. Membership Validity, Fees & Non-Refundability
- Membership Term: All NGSTA memberships are valid for a duration of one (1) year from the exact timestamp of registration and approval, unless revoked earlier for non-compliance with association guidelines.
- Registration Fees: Membership and registration fees are determined by the association’s governing committee and are subject to periodic revision. Applicable fees are displayed transparently before payment submission.
- Strict Non-Refundable Policy: Because registration triggers instant server provisioning, digital administrative allocations, and immediate delivery of downloadable personalized credentials and knowledge assets, all membership fees paid are strictly non-refundable and non-transferable under any circumstances.
6. Intellectual Property Rights
- All digital content, visual designs, trademarks, association seals, graphic assets, logos, website layout, code, webinars, digests, and publications hosted on the Platform are the exclusive intellectual property of the National GST Association (NGSTA) or its licensed content contributors.
- No user or member may reproduce, redistribute, republish, sell, modify, or commercially exploit any content, logo, or association insignia without explicit prior written authorization from NGSTA.
- Active members in good standing may display their official Certificate of Membership in their offices, professional firms, or digital professional profiles solely to denote bona fide affiliation with NGSTA.
7. Code of Conduct & Discussion Forums
When participating in NGSTA-hosted webinars, technical helpdesks, interactive forums, or community communication channels, members agree to:
- Maintain professional etiquette, mutual respect, and ethical standards at all times.
- Not post, transmit, or distribute any unlawful, defamatory, abusive, obscene, harassing, or politically divisive content.
- Not share confidential client records, unauthorized data, or infringe upon third-party intellectual property rights.
- Not utilize NGSTA communication boards for unsolicited bulk messaging, commercial spamming, or fraudulent solicitations.
The association reserves the unconditional right to moderate, delete, or restrict any content or account found in violation of this code.
8. Limitation of Liability
To the fullest extent permitted under applicable Indian laws:
- NGSTA, its office bearers, directors, committee members, and affiliates shall not be liable for any direct, indirect, incidental, punitive, or consequential damages resulting from the use of, or inability to use, our Website, digital certificates, or published materials.
- While we strive to ensure that all GST notification summaries, portal guidance, and tax digests are timely and accurate, NGSTA accepts no responsibility or legal liability for any filing penalties, system errors on external tax portals (gst.gov.in), statutory notices, or financial assessments levied against members or their clients by tax authorities.
- Members are strongly advised to exercise independent professional judgment and verify raw statutory notifications against official government gazettes before advising clients.
9. Suspension and Termination of Membership
The National GST Association reserves the absolute right to terminate, suspend, or revoke any membership, Member ID, and associated certificate without prior notice if:
- The member has provided fraudulent, misleading, or forged registration information.
- The member uses the association’s name, emblem, or certificate to mislead public authorities, clients, or government officials.
- The member engages in professional misconduct or activities detrimental to the reputation and constitutional objectives of NGSTA.
In cases of termination for cause, no refund of any portion of the membership fee will be granted.
10. Modifications to Terms
NGSTA reserves the authority to revise, amend, or replace these Terms and Conditions at its sole discretion at any time. Updated versions will be published on the Website with an updated "Last Updated" timestamp. Continued use of our Platform or association facilities following the posting of modifications indicates your binding acceptance of the updated terms.
11. Governing Law & Dispute Jurisdiction
These Terms and Conditions shall be governed by, interpreted, and construed in accordance with the substantive laws of the Republic of India. Any dispute, controversy, or claim arising out of or relating to your use of this Website or association membership shall be subject to the exclusive jurisdiction of the competent courts located in Thane / Mumbai, Maharashtra, India.
